Sask. woman wins legal battle against drug dealer

A Saskatchewan woman who says she nearly died from an overdose of crystal meth is claiming a legal victory over the man she claims sold her the street drug.

Sandra Bergen was suing Clinton Davey, but earlier this month a Saskatoon judge struck down his statement of defence after he failed to answer questions in a legal proceeding.

That means Davey is not in a position to dispute liability and the case will go back to court to determine damages, Bergen's lawyer Stuart Busse said.

Bergen says her win may be by default, but she'll take it.

"He can't go to court now and say 'I'm not responsible,'" she said Tuesday.

Bergen said after she overdosed on the drug in May 2004, she nearly died of a heart attack. Then 19 years old, she spent 11 days in a coma and was left with a number of long-term physical ailments.

Mexican Museum still searching for a home

Thirteen years ago, San Francisco's Mexican Museum unveiled the model for the handsome new home it planned to build on Jessie Square across from Yerba Buena Gardens: a terraced six-story structure clad in rough red stone, designed by Mexico's foremost architect, Ricardo Legorreta.

That signature building promised to raise the profile of the grassroots museum whose splendid collection of Mexican and Chicano art - about 14,000 objects encompassing pre-Columbian, Mexican folk art, modern and contemporary works - could not be displayed adequately in its cramped quarters at Fort Mason.

But after years of delays and stalled fundraising efforts, the Legorreta building has yet to rise, and probably never will.

"It's likely that it won't be built," said Tom Peterson, a longtime trustee of the Mexican Museum, which was founded in a Mission District storefront by artist Peter Rodriguez in 1975.

How to avoid foreclosure in a state that's leading the pack

Despite rumors that dozens of homes in the development have been foreclosed on, Banet said she has only had those two homes up for auction. There is currently a $500,000 Main Street home for sale, she said, adding that the most expensive home she's seen at auction was a $650,000 home on Phillip Schmidt Road.In a typical month, Banet auctions 25 to 30 homes, most of which are in the $70,000 to $100,000 range, she said.Hawkins and Banet agree that most of the auctions are because of people being approved for more money than they could afford."Last summer, I refinanced my house. Well, they called me back and said they'd approve me up to $400,000 and I said, 'well, that's great, but there's no way I can afford that,'" Hawkins said."To me, it looks like (mortgage lenders) are just lending too much credit."In fact, Banet said, one banker told her, "We tell them they can afford it, what we don't tell them is that taxes have gone up."Increased taxes have upped many local homeowners' mortgage payments $100 a month or more.Banet's own mortgage payment jumped 55 percent — from $600 to $1,150 — because of higher taxes, she said.

Republicans trade harsher charges as top Democrats wrangle over ...

I sincerely hope people will see through these sneaky tactics the sheer numbers of Obamabots who DISPROPORTIONALLY FLOOD to all these articles with message boards attached to them, are using.

Also, does anyone else see the contradiction between Obama's message of "unity", & these nasty, uncivilized, & vitriolic Obamabot attacks of Hillary on these online article message boards?

It's my estimation this was all a very well constructed attack plan by Oprah's gigantic, & extremely well oiled multimedia machine, when she decided to influence the next presidential election, with her power parlay move.

And to these same throngs of mindless Obamabots who keep bringing up this "experience issue" when comparing Hillary to Obama, one only has to compare the first day of occupancy of the next couple to get into the White House with all previous couples who've occupied the White House to understand how experience matters.
